Hi Holly: What you have is a three-toed box turtle. They like to be kept in a semi-moist environment, semi-shaded and they eat bugs, worms, fruit and veggies. Its probably a female, but a little hard to tell unless she opens up more.

That's not a tortoise at all...it is a box turtle. probably an eastern box....

It looks very sick. You should try and take him to a vet

yeah thats what we had thought...but she has 4 toes...but she could be a mix. she is very timid and shy. we just got her from this girl that fed her iceberg lettuce and spent no time with her :(

we knew she was sick when this girl had her...then we asked if we can take the turtle from her because she doesnt feed the turtle with the nutrients the turtle needs...

Hi Holly,
I hate to get on everyone :p but you have a Desert box turtle, Terrapene ornata luteola.
It's most likely a male, but would need to see a picture of the tail to be sure.
Here's a good caresheet to get you started. http://www.chelonia.org/Articles/Terrapenecare.htm
