Looks more like an eastern brown snake. When he opens his mouth does it look real white, like cotton?

I'm not a snake specialist but the thickness looks like a cotton mouth. Need a better angle on the head. Do you have those in OK?

Yes we have them, reptile guys said they are out in full force right now. I found in my flower bed, it doesn't look like the Browns we had last year, and it's bigger.

That's great, turn it loose. The aggressiveness shows it is not a cotton mouth. They usually don't get aggressive they will either slither away or do a partial to full coil with it's head tilted back with the mouth wide open and remain motionless until you leave and sometimes do a short strike if you get to close, with some you almost have to touch them to get bit. I know this species fairly well I have handled many in years past while extracting their venom.

Yeah, I don't see any reason to kill it. I just don't want it around my house.

Hearing "poisonous" applied to snakes makes me sad deep inside my soul.

It makes him sad because it isn't poisonous it is venomous.
If you bite the snake and get sick its poisonous, if it bites you and you get sick its venomous.
