I've never had a tortoise before just found this one in my garden.

I'm not sure what species but it's a turtle and when you find out what kind it needs to be set free if its native to your area.

I have no clue.
But it does indeed appear to be an aquatic turtle of some sort

This is an Indian Black Turtle Melanochelys trijuga. It would be best to return it to where you found it. It most likely came from a nearby pond.
