It is acutally legal to own a 3 toed box turtle in NYS if you apply for a permit through the state. I have already applied for it and am waiting for the approval. I run my own animal rescue, so Im pretty sure I will get approved. If not, I will do whatever it takes to get him into the right home...

what about under the tank heat? because the ambient air is 85ish with the heat light but hes always burrying himself deep within the substrate that is only 76ish - is it okay to put a temporary heating pad under the tank until he gets more comfortable in his new enclosure where he can benefit...
