Yep, I think so, too. For all we know, this person caught it illegally, and is now trying to pass it off as an African species.

Yep, he could. Judging by the pyramiding, it has been in captivity for a long time. However, he still could have caught it as a baby, meaning he might not have a permit for it. If he tries to sell it across state lines, he could get fined and might even serve jail time:

Thanks, I wanted to email letting him know but wanted to get a second opinion before I did.

I just sent them an email to the effect that this is a native desert tortoise, not an African tortoise. I let them know that laws exist regulating their sale, and that if they are in violation, they could face fines or jail time.
