Red foot tortoise sick?

I just got this little guy from the reptile expo and he seems a little weird, to start he's got one eye and I don't even know if he can see in the other and the bottom of his shell is indented.

is the eye actually missing? Did you happen to notice whether or not it was like that when you bought it? It could be a genetic problem born with one eye it could have happened while being raised with a bunch of hatchlings.
