We need more pictures to makw a solid judgement.

There's really no way for us to tell. We can tell you if the shell looks like its growing correctly, or if the eyes are clear and bright, but in order to know the tortoise's 'health' we'd have to see it and watch it in real life....does it eat, does it walk around, does it act alert, etc. We can't tell that from a picture.

Your tortoise's beak is in good shape, the shell looks fine (what I can see of it), the eyes look a little small, but like I said you really can't tell much from a picture.

He eats spring salad mix and various plants out side like dandelion. He sleeps all the time and scraps the side of the bin where I have him. I try to feed him pellet food I got from the pet-store but he never eats it.

How large is his enclosure? What is your lighting? What are your temperatures?
