I'm also slightly unsure of its gender? i was told if they have its tail down it should be a female but it does both

If you post a picture of your torts tail/bottom of the shell some of the experienced keepers can take a guess. How old/ big is your tort? If you mentioned it already I may have overlooked it.

It very much depends on the size of your tortoise.

We not only need a good clear photo of its underside including the tail, but also need to know the Straight Carapace Length.

All tortoises look female until they're nearing full size.
