Snake id please

So I'm taking Ink for a stroll in the front yard..

And spot this snake. I don't think it's a copperhead (I have had many in my yard) however I think it is a garter snake?? I picked up Ink, got him safe inside. I kinda knew in the yard where it was, so I grabbed a shovel, but it was gone. Please id the snake. Thank you

Very hard to tell by the pic ( definitely not a copperhead) im leaning eastern garter as well

I would say if bitten yes. But unlikely to bite since tortoises are pretty slow moving and the snake wouldnt consider it a threat or prey.

I can't tell from the pics. Its blurry when I zoom in. Kind of resembles a rat snake from what I can see of the pattern.

What would you have used the shovel for? I hope you would not kill a harmless snake? Or...a venomous one?

I had a snow shovel to rake the lawn in front of me to locate the snake. Then I would shovel it up and move it out of my front yard. No harm to the snake, tortoise or me. 😄
