What is the species of my tortoise?

It's either a desert tortoise which has not grown to full size for whatever reason or its a Texas tortoise. Definitely not a Gopher. I'm leaning more towards Texas tortoise (G. berlandieri). Where was this animal originally from?

I thought Texas tortoise from the first photo but it looks to large to be one. Unless I'm unaware of how big they can get. Plus his gular isn't split like in most males that I have seen on the Texas tortoise. I thought (maybe incorrectly) that male desert tortoises have a single in split gular.
