My yard is rye and fescue and the grass was never sprayed but the seeds were fertilized and this was 3 years ago can he eat it

Potential issues are other things in the bag with the fertilizer, like herbicides, and pesticides, things that offer multi purpose in one application. Those are where the danger can come from.
Once the fertilizer, just fertilizer, has been applied, and watered in, the grass is OK for the tortoise to eat. But if carrier particle are still visible/present, those small clay granules, then I would water it in more, until those carrier particles are dissolved into the soil. Those clay particles are still there even three years later, but now the particle size has gotten so small you can not see them. It's kitty litter for the most part, it is there effectively forever.
Foliar applied fertilizer, just fertilizer, like the Miracle Gro spray bottle you put on the end of the hose, are OK too, after two of three more waterings where the plants or grass has been watered in the same way as the fertilizer, just fertilizer, application had been done.
Those little dissolvable beads that are fertilizer, just fertilizer, if incorporated below soil surface as it says on the bag - those plants are safe to eat that, the next and forever after days from application. You don't want the tortoise eating those little beads though.
Plants need food too, stronger healthier plants are better tortoise food.

Many lawn products are now called "Weed and Feed", or something similar. These are the dangerous ones. They contain pesticides or herbicides, in addition to the fertilizer, and would be excluded by Will's fertilizer, just fertilizer, comments because they are not "just fertilizer".![]()

This is why I tend to go with indoor farming fertilizers they may end up in someone's lungsfor some strange uses. Will
