Is pepper tree safe?

I was just wondering if pepper tree was safe for box turtles. I don't plant on feeding it, but is it okay to have a pepper tree near the enclosure? I have a three toed box turtle. Thanks.

My box turtle enclosures are under a California Pepper Tree that is about 50' tall. They've lived there for about 15 years.

Similar story here. I've had many tortoises under or near CA pepper trees with no issues.
