It wouldn't be toxic but if he did eat some it could still be deadly. Your tortoise may be attracted to the different colored bits in there, its just not worth the risk. You might be able to pick all the perlite out if you're patient..

What you've been told is correct.
You want the plain Orchid bark. Not mixed with anything.
They're both found at Home Depot.
