I don't think they check or care. However bringing them back is a whole other issue when animals are concerned. You will need proper permits and papers.

Best to leave the tortoise at home, in my opinion.
Let alone the paperwork for bringing it back into The USA, never mind into Mexico, the journey and new environment would be very stressful for the tortoise.
You need a tortoise sitter.
