That's a box turtle. I'm bad at identifying which kind it is but it looks like a 3 toed box turtle

I believe the eastern box turtle are native to New York.

If the plastron(underside) is dark then it's most definitely an EBT. My guess it's an Eastern just based on location like Craig stated.

Are you sure because I counted 4 toes should I take a closer picture

the three toes would be on the hind feet only. the fronts would have the normal 4. If you found this turtle in the wild, it is probably and Eastern box turtle. But if someone else owned it, it possibly is a three-toed.

Count back toes per foot. If 3. a three-toed. If 4, an eastern.

You are correct. New York has pretty steep laws about wild fish/game/reptiles. If I am remembering this correctly as of 2006 you must have a permit to own a native New York species of turtle.

That is correct. You have to have a permit to keep NY native turtles.
