Agreed. It's a box turtle and definitely not any kind of tortoise.
Look at the top of the head. Tortoises have scales on the tops of their heads while turtles have smooth skin, not scales on top of their heads.

Definitely a Box turtle based on the plastron from my view. Earthworms(not Nightcrawlers)are great turtle food for any small meat eating species and can be dug in the yard for free.
Something seems odd here....
